Wal-Mart Blames Tracy Morgan for Collision, But Suggests Settlement

In June, “30 Rock” star Tracy Morgan was involved in a collision, which left one person dead.  The incident left Morgan hospitalized for two weeks after suffering a broken nose, ribs, and leg. Morgan and three surviving passengers filed a lawsuit blaming Walmart for the tragic accident.

The group insists that Walmart “knew or should have known” that the 35 year old truck driver (Kevin  Roper) had been up 24 consecutive hours when the crash happened. They insist that the incident may have been prevented if the Walmart driver had an ample amount of rest/sleep.

On Monday (Sept 29), Walmart filed court documents suggesting that Morgan and the other passengers were not wearing their seat belts at the time of impact.

“Plaintiffs’ injuries, if any, were caused, in whole or in part, by plaintiffs’ failure to properly wear an appropriate available seat belt restraint device.”

Although Wal-Mart’s initial response to the group’s lawsuit puts blame on them, both sides will have to an opportunity to defend their stance. However, a representative of Wal-Mart says that they are also encouraging settlement discussions.

In August, Morgan’s attorney told press that the actor is doing much better, but is “still struggling.”
