Take- Two Interactive Software, the maker of NBA 2K, won the dismissal of a lawsuit that could have cost them billions.

Take- Two incorporated eight tattoo designs worn by several high profile, digital NBA players (i.e. Lebron James, Kobe Bryant, and others) into their NBA 2K series. Solid Oak Sketches filed a lawsuit siting copyright infringement, which could have forced Take-Two to payout $150,000 per tattoo image.

Manhattan’s U.S. District Judge Laura Taylor Swain ruled that Take-Two cannot be held liable. However, Solid Oak can still sue for loss of profits due to the unauthorized use of the tattoos in the NBA 2K16.
