The war is still on between Marvin Gaye’s family and Pharrell Williams and Robin Thicke. Williams and Thicke are steadfast on getting a new trial, after losing the “Blurred Lines” copyright infringement case. A judge awarded Gaye’s family $5.3 million plus ongoing royalties.

The family is aiming to stop a retrial. Williams and Thicke’s legal team want to challenge the fairness of the musical compositions’ examining and whether or not they reused a significant portion of  Gaye’s “Got to Give It Up,” which was released in 1977.  They also claim that there were several legal errors that caused the jury to include unprotected aspects of the song. Over 200 musicians are in support of Williams and Thicke with belief that the court’s judgement eliminates “the line between permissible inspiration and unlawful copying.”

 

Now, in the 9th Circuit Court of Appeals, Gaye’s family insists that the original work was used without consent and unfair compensation.
