This is one of the most common errors people make when filing their taxes. It is illegal to claim a child that isn’t rightfully yours. Bu, it is bad when you claim your child and the mother (or father) has already claimed them in the same year. Sometimes confusion appears when parents share dual custody, or when a grandparent is the guardian but the parent is still claiming the kid(s). If you are in that position, the IRS auditors will require you to provide detailed proof that you are indeed the primary caregiver for the child.
